EB-2 National Interest Waivers (NIWs)

Are you a professional with an advanced degree (for example a PhD., Masters), who has worked on a project or research paper in furtherance of your career or some cause? Is your area of specialty one that could be useful to the US, for example, in the fields of engineering, medicine, technology, or mathematics, computer programming, business executive? Are you a professor?


If your answer to any of the above is “yes” you could qualify for a NIW that could potentially set you on a path to citizenship. If you are such a professional, here are the visa options you could qualify for besides an NIW:

  • O-1A - Extraordinary Ability (science, education, business or athletics
  • O-1B - Extraordinary Abiity (arts, motion picture, or television
  • O-2 -  Support Personnel

First Preference: EB-1

Second Preference: EB-2

Second Preference: EB-2

   Reserved for those whose skills and qualifications are most desirable, or who have exceptional achievements in business, arts, or sciences.

Second Preference: EB-2

Second Preference: EB-2

Second Preference: EB-2

Reserved for professionals possessing advanced degrees or exceptional skills in their field.

Third Preference: EB-3

Second Preference: EB-2

Fourth Preference: EB-4

  Reserved for skilled workers with a bachelor’s degree or equivalent and/or 2 years of work experience in their field; or unskilled workers in a field US businesses need.

Fourth Preference: EB-4

 This is for special immigrants like religious workers whose religious non-profits require them to relocate to the US.

Fifth Preference: EB-5

Fifth Preference: EB-5

  Reserved for foreign nationals investing significant funds in US businesses that create opportunities for at least 10 workers.

Sometimes, a permanent visa cannot be achieved; however, temporary visas are available in those instances. H-1B visas are highly desirable and most common and are sponsored by

companies located in the US. These are for occupations like doctors, accountants, software

engineers, and other skilled professionals.
